Welcome to the website of contemporary artist Stephen B. Whatley. The artist requires that in communication and business transactions regarding the purchase or commissioning of original works of art and purchase of limited edition prints that you accept the following terms and conditions of use.

Definitions and Terms:

The term ‘the artist’ refers to Stephen B. Whatley. The term ‘you’ refers to you, the user or viewer of this website.

Copyright of Displayed Images:

The copyright of all reproductions of art – unless specified – is owned by Stephen B. Whatley. While you are welcome to view, print or download the contents of the website for personal use, the use of the artist’s images for re-publication or commercial purposes, reproduced in any form, is prohibited – without prior communication and permission of the artist.

Colour and Reproduction:

You understand and agree that the artist makes every reasonable effort to display accurately the colours and contrasts within the reproductions of all works. However, because individual computer monitors and mobile devices may display colours differently, the artist and disclaims all liability in this regard.

Modification of Image and Information Content of Website:

The artist reserves the right, at his sole discretion, to modify images and information at any time and without prior notice.

Description of Works of Art & Prints:

The description of paintings, drawings and prints is approximate and the artist reserves the right to make changes, without notice; which do not materially affect the quality of the original works.

Purchasing /Commissioning Original Works of Art and Buying Prints:

Please email the artist when you have selected original oil paintings or original drawings to purchase, or wish to commission a work of art – via the Contact page or the email link on each page. You understand and accept that you are electing to commission a work from the artist, respecting his unique and distinctive style for which he is known. Limited edition prints can be ordered directly from the Prints page. 

Price and Payment:

The prices of the original works and commission fees and prices of prints are the prices quoted on the website at the time of the agreement of a transaction. The artist reserves the right to modify his prices at any time. Full payment, via bank transfer is required for original works of art, following communication with the artist; prior to shipment of the work. When commissioning an original work of art by Stephen B. Whatley, 50% of the agreed fee will be required prior to the artist undertaking the commission, followed by the balance on completion of the work; prior to shipment. The production of limited edition prints will proceed once payment is made via Paypal or via bank transfer, on the Prints page.

Delivery/Shipping of original works and Prints:

Insurance, secure packing and shipping of original works of art and prints to any worldwide address is free to buyers of the artist’s work. The artist ensures that oil paintings and drawings are securely crated and shipped – and tracked; details of which are notified by the artist. Prints are securely packed in a black tube and dispatched by Special Delivery (UK) and International Tracking (Royal Mail). The artist does not take responsibility for any Import Duty or Taxes together with any advancement fees or administration charges levied by the carrier that may fall due and payable to the carriers, authorities, governments or agents in the country of final destination. In the unlikely event of loss or damage in transit then the artist must be notified immediately.

Privacy:

The artist promises to honour client privacy and contact details including email addresses, telephone numbers and addresses which will be kept entirely confidential. Any other personal information supplied – such as photographs for commissions undertaken from photographs – will also be kept confidential.
